Getting husband to USA from India

I married in Bangalore India in March.I am from the usa and have since returned to the usa after spending 1 month in Bangalore.
I called the embassy in Channia and also New Delhi asking how to bring my husband back with me.I was told so many different things finally one man in New Delhi INS told me to file a I-130 form I was told to come back to the states and do this.
So I came back here.Now my problem is this.Lawyers are asking me for a lot of money to file all these forms for me and to bring him here.I have been told 2 1/2 month up to 3 years by diffrent lawyers.The man in Delhi told me it will take about 8 weeks to get his visa but there is never any promise as to the length of time.



I have been questioned by so many is this for money?Is he useing you to get to the states the answer in no he is not paying me and he is not useing me.

What I want to do is file the I-130 and return to India and go to INS in New Delhi and try from there.Been seperated from him is very hard on us both.
So my question is can anyone tell me if this will work or if I should stay in the states and do all work from here.If anyone knows a faster way for me please post here.

I have considered moving to India permantly with my 2 minor children but the language problems for me will be hard.Please anyones help in this will be so appericated,I just want the fastest way for me and him to be together and something in my price
 
Your best option is DCF whereby, you can go to India and apply for his visa from there, that way, it might take much shorter, than here. You are looking at 2-3 years, depends on which state you file in.

You do not need a lawyer, go to Barnes & Nobles or BORDERS and try to get a book on US Immigration. Lawyers charge anywhere between 1200 + INS fees or 3-4K.

Again, this is just my advise. You can visit uscis.gov for more detailed information. Also, the best advice can be gotten by emailing your question to HOMA. Believe me, she is the BEST.......

Thank you for your message I dont understand what HOMA is or what DCF is.Please let me know.
Can you or anyone tell me why it takes so long to process a visa? I know Sept 11 has caused a lot of security problems for us all but my husband has his police clearance report he has his passport and all he needs is a visa stamp.In India I am told it all depends on the interviewer if they are in a good mood they give if not they deny.
When I applied for my visa to India I had it mailed in and mailed back to me it took 6 days for all of this.

Two options

You have two options

Option 1: File I-130 at Texas Service Center (as I see you are from Tenesee). Once you get the acknowledgement, you file I-129F for K3 visa. Your husband would come here on K3. Then I think he adjusts to a permanent residence. The whole process may take 6-10 months.

Many people have done these steps on their own. However, you need to to thorough research on the net on different aspects of it. I personally I am not familiar with this process.


Option 2: File DCF (Direct Consular Filing) at New Delhi. They will accept I-130 application at their discretion for visiting US citizen. Both husband and wife have to be present at New Delhi for the first interview. Typically, they accept application for couple who are considered typical for Indian standard. Based on what you say, I would say you run high risk of they not accepting your application. It is just my hunch. Also, the money to buy ticket may be used to hire lawyer for option 1. But if they accept the applicaiton, the process is much faster. This option takes approximately 3 months. As they send document from New Delhi to home consulate for the second interview.

I would start with google search on K3 FAQ or DCF New Delhi. There is lot of information and you have to go through them to get the picture.
