Getting H1B in the embassy during EOS

Hi guys,

There is a question on DF-156 (application for non-immigrant visa) "Did you or somebody else on your name applied for permanent residence in US? If yes then who?"
I'm going to apply for my H1B extension however I have already filed my I485 for employment based green card. How should I answer this question. Does "yes" automatically means that you are have immigration intentions?

H1-B visa holders are allowed to have immigrant intentions. So, say "yes", nobody should question it.
 
In the consulate in my country they have their own understanding of the phrase "dual intentions". They say that when I'm applying for a visa I should have only one intention - to work for my sponsor. Dual intention means that I may change this status to permanent residence.
But if I have immigration intentions when applying for a visa, then I'm not qualified for it. That what they told me.
I'm thinking about getting visa in Tijuana, Mexico.
Do you think that will work?
