Getting fired--on 4th H-1B (EB3) renewal

Hello all,

I just found out that I am in danger of getting laid off towards the end of the year. I need some advice--I am feeling rather depressed.

I am expecting my 4th renewal of my H1-B (i.e. I am in my 10th year of H1-B) to come in any moment (my current one has just expired, the I-94 also--they expired in July 2006). My Priority Date is June of 2002. I received my Labor Condition a couple of months ago and last week I filed for my I-140.

If I get fired/laid off at the end of the year do I have any options? Or, must I leave the country within 10 days?

(My company is paying for lawyers so far, and they have all the paperwork.)

No, not yet...
My Priority Date is June 2002, and the current Visa Bulletin for EB3s has a cutoff date of March 1st, 2002, which does not include my Priority Date. I will be filing as soon as the cutoff date becomes current. It may be next month, in 2 months, in 3 months... who knows...

I have just filed for the I-140. I filed last week...

Ok, well I think before December you should be able to file for 485. I suggest you pay the extra 1000 and get your I140 approved in 1 week. I would also try ti make some kind of a deal with they employer that to keep you on board for 6 monts or so. Even if it is unpaid leave.

As far as you labor. Which state did it process from. My labor is still pending since Oct 2001 in Texas EB3 non rir. What kind was yours.

Not to panic, I am sure you company will work with you for that long. I mean, they keep you on board and not pay you. In order to be safe, you must have file 485 and 6 monts have passed.

Mine was EB3 RIR, and I am located in New York. But I am not sure where it was sent. If you need I can find out.

Hmmm... Unpaid leave counts towards the 6 months?
