Getting EAD for spouse while I-140 is pending...

Gurus,

I have filed 140+485 concurrently after the July 2 fiasco, like a lot of people here on the list, I guess.

From what I understand, once I get the 485 receipt, after 90 days from the receipt date, I can go to the local INS office and ask to get an EAD for me & my spouse (she's currently on an H4). This will let her work in the US.

From the current 140 processing times, I anticipate it will be atleat 5-6 months until I get my 140 approved. My question is, can she (as well as me) get an EAD based on the 485 receipt date even if the 140 is pending?

EAD Cards

You could've submitted the EAD application along with the I-140 and the I-485 applications. My wife and I got out cards last monday. we filed all together. please ask your attorney for an EAD application, I think is form I-765. it'll take 11 weeks to be processed.
