Guys, I am in the process of planning my trip abroad to canada or India and get H1-B stamp on my passport, H4 on spouse's passport. The sole purpose of doing this trip is to get back on H1-B, H4 status from current EAD status. I wanted to ask you guys if anyone has done this status transition before successfully without any issues? please advise.

Do you have a fresh H1

Your old H1 was considered abandoned when you started using EAD even though 6 years might not have been completed. Therefore in order to switch back to H1 you should be having a fresh H1 within this year's quota. Otherwise you have no means to enter back on a H1.

Wrong answer.

If your H1 petition is valid - then you should be able it to get an H1 visa. An approved H1 petition never expires, until its expiry date, unless revoked.

Hello I had a question on the same grounds. Me and my spouse got our H1B & H4 stamped on our passports in 2003. The stamp expires on 1/13/2006. If I get a new H1B petition processed under the Master's quota can I just cross the border and come back or should I take an appointment for a fresh H1B & H4 Stamping. Please respond
