getting an E2 visa - 2 questions

Hello

Seeking some advice

I'm British and arrived here on a tourist visa, which has since expired. I still am here in the US

1)Would it be possible for me to apply for an E2 visa? I read somewhere that it was possible. 2)Also what about this other thing of having a business and it generating $1m in assets and applying for residency that way...Is this at all possible?

2. Yes, the investment is a bit less if it is in a disadvantaged area. $750,000 has worked.

Your visa has expired, so now you are illeagal, how long ago did B visa expire?

You need attorney urgent, maybe file extension to B visa, may or maybe not possible as you are now illegal

You may put offer in on a business subject to E visa approval. An E visa does not lead to LPR. You will be allowed to stay till decision, but I am concerned at you current status

I think you are getting mixed up

The is an Entrepeners visa which will lead to green card. You have to invest $500,000.00 upward and other conditions apply

I am assuming you entered on a 90-day visa waiver as a British national. Once they 90-days expired you became out-of-status. Depending on how long you have been out-of-status, you may or may not be subject to a 3 or 10-year bar.

Assuming you are not subject to such bar, you could apply for an E-2 visa. This type of visa is for investors who want to buy out an existing company or open a new company of their own in the U.S. You must invest substantial funds and these funds must be at risk. The E-2 is great because although it is not a path to the green card, it is continuously renewable as long as the business is operational.

The EB-5 is a green card route for investors. You must invest $1 million typically or 500k in an underprivileged area. The application process for this can be quite lengthy. Hope this helps!

You say you came on a tourist visa?

Is this a B visa? or visa wavier program ? The visa wavier program is not a visa. Visa Waiver means NO visa


If you came on B visa and still within the 6 months then yes you can apply to change to another nonimmigrant visa

But if you are out of time then the longer you overstay in the US the longer the ban from re-entry into the US 3-10 year ban

You are wrong


There is NO need for a visa if you come from a country that has a WVP, unless of course you have a criminal record or other reason that does not allow someone to #waiver the need for a visa #


The VWP mean's # Visa waiver program ! #


Even if you have a visa, B L H1B student visa this does not mean you will get entry into the US

The immigration officer at POE has the right to deny entry to anyone and does not have to give a reason and you are also wrong when you say the POE gives you a visa

Look into it if you wish, it is a variant on "B" status.

There are many many reasons someone from a VWP country would need a visa, far too many to list here.

Nobody, except a USC is guaranteed entry. The main advantage of the VWP is that it allows you to avoid applying for a non immigrant Visa IN ADVANCE.

The POE determine admittance and would grant VWP admission.
