getting 7th year H1 extension with Pre-approved Labor while EB2 PERM labor is pending

My H1 6yrs will be ending soon. Company A applied for my labor in EB2 category through PERM in July 2005 and it is curently in-process state. As I cannot get my 7th year extesion on that labor, the company is ready to use pre-approved eb3 labor. Will there be any problem in applying for 140 using the pre-approved labor when my eb2 is still pending.
Any help is appreciated.
 
It should not

INS will not know...as per the forum, nobody till now had any problems with such issues....hope it helps.
