Get dependents in OPT status

Hi all,

I am currently on F1 visa which expires by May 2005. I have applied for OPT and will be getting my EAD by then. I will be going to india while on OPT and will be getting married in August.

My question is: Can I apply a dependent visa for my husband while I am on OPT and an expired F1.

Please Help.

In OPT you are still considered F1 as far as I know. I traveled myself while I was on OPT with the F1 visa and my husband traveled with his F2. Do you still have the F1 visa valid? He can apply for F2.

Then you need to apply for a new visa to US consulate yourself to return in US in august. How else could you enter? And when you go, he can go too for his F2.

Well I am hoping that I can come back if I have the EAD card and offer letter of the job.

But it looks like he may be able to come. as OPT is temporary visa status.

Its confusing.
