Get a Legal Name Change in Your State!

Hi All,

I read some posts where people use their right to change their name through common law. One person said that they had 4 parts to their name which included two last names such as their mother's maiden name and their father's last name: for example:

John David Rothchild Swanson
(First Name, Middle Name, Last Name, Second Last Name)

Soon the name becomes:

John David Rothchild

This is because everything legal primarily asks for first, middle and last name, the fourth last name is obsolete, and thus many people in this forum choose to eliminate it. This process, if done at will, is allowed through common law. However, the Federal government is not required or obligated to recognize this change through common law.

Solution:

Get a legal name change if your chosen name differs from your birth certificate or passport. For this you will need to go to your Superior Court and get a court order to change your name. The process for legal name change through a court order will be expensive and take about 6 weeks.

Basically:
1. You go to your local Superior Court
2. Request name change documents from the Clerk
3. Fill in the forms correctly and acquire the fee.
4. Submit your forms for name change and fee to the Clerk
5. You may need to publish the fact that you are changing your name in a local newspaper for 1 day each week for four consecutive weeks
6. Get a criminal background for confirmation that you are not doing this to avoid prosecution, legal action or that you are a sex offender or on parole.
7. You go to court on the day of your hearing.
8. You get a signed, official copy of your court order

I hope this helps!
