And another thing he mentioned that is interesting was H1-b dependents seem to "get lumped together." Last time we did an infopass on 3/2, we were told something similar. They seemed to be implying (but they did not explicitly say so, so take it for whatever it may be worth) those cases are often kept on hold for a while for sorta fine-tuning (numbers calibrating). Considering the way DOS was so conservative about authorizing visa numbers during the first three quarters this FY, this seems to make sense. In fact, we had it confirmed today (and it is 5th time we've confirmed this!) my spouse got NC cleared in two weeks and got everything cleared in a month. Really no other clear reason it's still pending in that light.


So if the dependent is on H1b status, they will keep the GC on Hold for numbers calibrating....

Did they told you how long it takes or did they told you..is visa number will be allocated...etc...

do you think if the spouse is on H-1B their GC will be on hold? why? any specific reason? my spouse case is with the officer for the past couple of months. everything is cleared. god only knows why the service centers do that "ON HOLD".
 
That's what two IOs at our local office implied. Note, however, it's just what they implied and they did not explicitly say so. Perhaps, that may be their own understanding of such a case as my spouse's and the reality may be something different. But the IO who talked to us the other day did say they (CIS) get those H1-b cases (dependent, everything clear) "lumped together." In our case, my spouse got everything cleared within a month after we filed I-485, yet me alone got approved and her case has long been "pre-adjudicated" for no clear reason. So we tend to think their implication makes sense.

The IO said her case had a visa, but he has no clear idea when it would get approved ("Could be tomorrow, or may not happen within this fiscal year."). But TSC IO said to her today she had no visa yet. So we really don't know about our own case.

But if your spouse's case has all securities cleared, and you guys have old PD/RD... so I would assume things are different (our cases are after all relatively new). I hope you will hear good news soon.

I think so...I was on H1B for 5 yrs when the I-485 was applied. I am using EAD now, I-485 is still pending..name check was the last reason that I heard..have not get anybody so far to get the new reason
