General Question Pls suggest

My I140 is pending at CSC for abt 5 mths now. Also my wife is studying on an H4 and she is not able to take any assistantship that is being offered to her etc .
With the I140 not moving at CSC , I am strongly considering converting my wife's status to F1.
She is currently on an H4 .Recently I had got an H4 extension approval for her till 9/30/2006.
for this.
1. Would it affect her Green Card application (My I140 RD is 5/30/2003)
2. Even if it does not affect the GC are there any risk's involved .

Converting H4 to F1 is not advisable. H4 is dual intent whereas F1 is not. She is better of being on H4. Besides it may not be so easy to change the status. You need to have enough valid reasons. If you contact her school, they might say the same thing.

If she is interestested in internship, why don't you initiate I485 & I765(EAD) & AP for both of u. You will get EAD in 3 months. If not you can get interim EAD from local CIS office after 90 days of ND. Now EAD for concurrent filings are being processed very fast. EAD applications for first time concurrent filers ( not renewals) are being given preference over other EAD applications.

thx Novis. the problem is that my employer is not ready to do that till i get my 140 approved . i would assume u know the reasons .

pay for I485 filing right away. When the I140 is approved ask them to refund the money.

if a company is so inconsiderate - you might even consider why you are working (slaving) for them.

NO The money is not the problem .they have just decided it as a policy because people leave these days with the ac21 rule .so not doig it parallel will help them force the consultants stay longer.

My I140 RD is Sept 29,2003 (EB2, RIR at CSC). My employer's corporate policy is not to file for concurrent filing.
I am planning to bear the costs. BTW, what's the fee for concurrent filing?

the fee is not much .but u will eed a special employment letter .what abt that ??? also are u going to tell ur employer u are doing it or not.. what uf u get a RFE etc . i think there are just too many risks involved

I doubt that higher priority is given to 1st EAD.
My case is concurrent filing. EAD is not granted yet.

All people I know who have gone for concurrent filing have got their EAD approved within 3-4 months even though some did not get the card within the timeframe.

Did you get any RFE on I765/I140? If not, you might try getting interim EAD ( even if you don't need/use it); just for the sake of checking if your I140 is on hold. CIS won't issue interim EAD if I140 is on hold.

I did some scan for my WAC date and found that 813/1156 I765 applications have been approved.
 
Hi

I am appying for i-140 concurrent filing. I just have a three year diploma from india. That is it period. Do i stand a chance to get my i-140 approved. This is being applied from california.

Can any GC gurus suggest me anything that i need to confirm before filing. It will be files on nextwed say 13/14th of this month.
 
rsnmurthy, what does the column 14 (minimum requirement) on your ETA 750 (LC) state? Which category are you filing in?
