General question about LC for newly grads

I would like to have a general idea about how things actually work to prove that there is no qualified US worker for a position of LC petition.

Say I am a programmer. I have MS in CS and was hired right out of school. I had some on-campus and internship IT experience while in school, but the skillset used was not closely related to the current job.

So what are the requirements to put in the job ad? Probably Bachelor in CS since I don't think Master could not be a MINIMUM requirement for a programmer. Can I use the part-time experience? Can I say "require XX skills"? I don't have work experience for these skills, although I AM proficient in them, mainly through courses or learned by myself.

I guess this is a very common senario since a lot of us are just out of school. Could some explain how LC petition works for them?
 
You are right, unless all the "programmer" position in your company requires MS degree, it is not possible to use MS as a requirement. But as in any job ads, you may have BS + experience or MS + 0 (MS does count for something), you probably can use that, but you should have had an pattern of hiring with such requirements.

LC works on the permise that "there is no qualified US worker" OR that "there is no willing US worker". So even if there are qualified workers but not willing to take up the job your LC can be certified.

Programmer can be put a min requirement for a job. Job can figure around 70% of prograaming jobs and 30% of other duties. You may use part time experience. If you have not worked on them - you cannot use it.

I'm in a similar siutation too , BSc in Info Sys working on OPT right now with H1 starting in August.

But I work for these small biz gora's, who are not going to be willing to do the RIR, it was so hard to even get the H1 out of them.

Is it possible to use a placement agency to do the RIR, and list the requirment as BSc + 1 year (I have 2 years part time).

I'm doing Sys/security Admin Level 1 wage in MD.
 
LC with no experience:

DOL might issue a RFE asking for campus recruitment. Depending upon education level required for the offered position and also looking at the job market, company will end up having a lot of resume.

It's hard to prove the case for LC if experience required is less than a year.
 
Would I have a better chance if I applied for LC a year from now:

As then it will be the 1 year exprience I gained while I was an undergrad, and the 1 year that I'm currently gaining with my employer?

Yes indeed, if PERM is not around. PERM, they say is real tough one to get thru.

Also your experience with surrent employer won't count.
 
If I apply for an LC now, and get rejected, would that negatively affect me if I apply in the future?

The other thing is my employer probably wouldn't be willing to do the RIR, is there a way around it, say a placement agency?
 
No, current LC rejection will not affect any future LC application, but once a LC is rejected you cant apply for the same post for 6 months (that is the same post within your same company).

Question on RIR/ NON RIR

All,

I am new to this posting. I would appreciate your help in answering these questions.

I have a masters degree with 4 yrs of exp.

1) RIR/ Non-RIR

My comp has started my LC process...they have issued an Ad in newspaper....2 on print(2nd ad after 30days from the first) and 45 days continuous on internet......So do i come under RIR or non-RIR

2) I assume that with masters deg in US and 4 yrs of work exp I come under EB2 category

3) I come under IL SESA and Chicago DOL...So how long does it usually take to get LC cleared.

Thanks a lot in advance.
