General CP questions...

I'm yet another indian guy working in US on H1B visa for the last 4+ years. I've already got my I-140 approved/cleared more than a year ago.

I'm planning to get married in India by end of 2003 and I'm thinking of doing CP for myself and for my wife around that timeframe. (My fiance is in India and has never been to US)

My questions...
1. Do you folks recommend doing CP right after the marriage? Will there be any issues?

2. How long does it take to get an appointment for CP? (As I said, I have my I-140 approved. I haven't taken any steps to start my CP yet)

I am doing CP right after marriage. There is no problem whatsoever.

Here again, the considerations are:
1. Do you intend to make 'ONE' trip to India to get the GC (thro' CP) and get married at the same time?

2. Do you plan to get married bring your wife to US on H4 if possible and then go with her to India to get the Interview done?



2. How long does it take to get an appointment for CP? (As I said, I have my I-140 approved. I haven't taken any steps to start my CP yet)

Depends on few things.
1. If your case for I-140 was filed as AOS (looks to me that its most likely the case for you) and if you belong to chennai consular region, you will have to file something called I-824 and depeding upon which service center you belong, it takes about 8-12 months. From the approval of I-824 it takes about 4-6 months for you to get the interview appointment

2. If you belong to either Mumbai/New Delhi consular region then you could do something called AC-140 (Attorney Certifed 140). There are lot of fourms on this. Research it.

My original plan is to make one trip for both my marriage and CP. Now that you said I-824 will take 8-12 months for approval, I might have to reconsider. :(

Chennai has NEVER accepted to process AC-140 cases. Their workload is the highest among all consular posts in India and also rank in the top 5 in the world. Given the present situation and the new requirement of interviewing most non-immigrant visa applicants, their workload is only going to increase.
You will have to go the regular route.

Even in their website, the DO say that they accept AC-140 on a case-by-case basis and IF their workload permits.

There has not been a single case of AC-140 at Chennai reported in this fourm. I gave it a shot. I had called them up from US (what a waste!) only to know that they would not accept AC-140 now.

Try your luck and post your experience.
