GC with tiny startups?

After 485 pending for more than 180 days, I am now with a startup which was funded not very long ago and has no real revenue yet, however it continues paying me the salary as stated on the offer letter so far. Hopefully the company will become self-sustainable soon.

Not sure if INS denies cases because they may think the company is too small/un-stable, Is there any one with/heard of such experience? Or what's your opinon?

Small & unstable employer since 1996...

For those who do not recall my previous post: I worked for a Piscataway, NJ based company for almost 4 1/2 years . Never changed employer after 3 years of h1b they applied for my extension and also for green card. Now my GC application is pending over 16 months and finger printing done a year ago. This desi employer all of a sudden laid off me. Reason do not have enough money to pay my salary 90K/year. I paid him almost 12,000 cash so he can keep my green card process alive. On top he owes me for almost 370 hours less appeared on my paystub. Before he laid me he signed a letter from me that due to family issues I have to take periodically leave of absense and will not put full # of hours. He lied one after another. Now in this economy it is not only hard for me to find something right away but for 90K and similar title really make me worried. This employer also has history of audit with department of labor. Just 3 years ago this employer was audited for wages fraud and was fined by State of NJ and end up paying full wages to employees who filed complaint. I also contacted DOL, NJ and explained the entire situation (without giving real name on e-mail). DOL investigation officer wrote me mail saying I msut provide few documents which I have and they will investigate and that employer could end up paying 100% salary he owes you + 18% fine and also due to the fact this is his 2nd falony he could get up to 3 years prison. Even though I want to teach this indian lesson but at the same time I do not want him to go to jail......... What should I do I just want him to give me my money and never show me his face.
