It looks like I am following the wrong crowd. Give me two advantages of staying back besides Dollar and going thru this hell

With current globalization going on ....are we crazy?

Well, it all depends on how you look at it.
I am not going through hell.
I have a good stable job and interesting life here. I love California and I am happy I get to live here.
With all the contacts I acquired over the past years I am confident that even if I loose this position I'll be able to find a replacement.

If I get my green card sometime - it's cool. If not - I'll figure out what to do next. Maybe I'll take a year off and go travel somewhere.

The point is - don't wait - just live your life as if you had your green card already.

While waiting for GC process to continue, you should think about having a Plan B... look at other countries.
Right now, I got two processes going: the GC process and Australian Permanent Resident process.
I did my university degree there so I am familiar with the lifestyle.
Australian PR is self-petition... through points-based merit system.
Whichever process finishes first, I will take that.

labor_replaceCheck what april4 is saying, if you wanted to lead good life in US not think much about the GC. Apply it and forget it. And that too apply by getting a full-time offer (With slightly good company)... Risk is - if they lay-off you, u have to go back to India and no other way. But, thats alright as u must would have earned good money.
What I understand after working in consulting for little less than 2 yrs is, you are carrying a lot of personal risks (Medical, Housing, relocation etc etc etc ) and all either u pay and get some good biling rate or employer will support in that and finally end-up in getting less salary and that salary is also not gurannted for ever. So decision is all urs. I think in very conservative way. I was working for a big desi indian off-shoring company and they used to pay less as compare to what the consulting company. But yes, however the personal risks were less. But the major risk was, if anything goes wrong with the client u will go back to India. SO NO DOLLAR salary. Isn't u left one of the big Indian company and doing the consulting. I would say that u have taken a good decision and now the next step before you apply for GC is to get a full-time position and then apply.
 
i would rather suggest that instead of a full time...we should get with a good consulting company with a bill share basis.....that way you can keep changing jobs.......and still the GC process will continue....and you wont be stuck with the same job.

infact in Atlanta i know few american consulting companies who are pretty reasonable....and who can sponsor H1/GC.

I have asked myself these questions several times and have come to the conclusion that I cannot let this GC process rule my life. Its hard to not think about it but I try to take my mind of it as much as I can and do what I can to make the most of the situation I am in. For people like myself it comes down to the amount of time already spent in this process. I am not willing to give up at this stage because I have already spent 5 years in this process and want it to count for something. If I had just started the process or had spent only 1-2 years in it, I would be more proactive about seeking alternatives.

I do believe that all of us need to have plan B in place. We immigrants would be foolish not to do so. We should try to use as much of the resources and opportunities that this country affords us. That way we would have made the most of it even if in the long run we settle somewhere else.

Saras, have you considered changing jobs using EAD to keep your career at least a bit more diverse, or are you satisfied as is ?

Recently I have been thinking long and hard about changing jobs but I am a little nervous about it. I know that a lot of people have used AC21 but I am a little hesitant to create more potential complications in my case. My case has been through a lot of USCIS errors (wrong transfers, RFEs, lost applications etc) and I just don't want to give them another reason to mess it up again. I have been with the same employer for 7 years have a bachleros from a very good US college and everything about my application and my status is clean but for some reason the USCIS has chosen my case for special abuse. A lot of people from my company who applied with me on the same date and similar backgrounds, pay, education got their GC's over a year and a half ago. Anyway .. its just painful to think about all this crap.

The other thing is that my PD is August 01 and I am hoping that my PD may become current sometime this year. If that does not happen then I will def try to get another job. Lets see how things go.

Risks and rewards

I was working for the same desi company back in India (my first job) and worked for them for close to 8 years (2.5 back home and rest here). Finally, got fedup of the tiring work, joined an american co. using my EAD. All the company did was provide me a letter and my attorney took care of the rest.
My current co. never sponsored anybody for H1 or GC. Touch on wood, thats why they dont hatve a slave/cheap labour attitude as my prev. job. As such I am very laid person, never took any chances. Yes, with AC21 I complicated my case, had many doubts in mind, but gathered courage to move on. My case approval probably took more time because of the RFe, local office transfer and the retrogression thing, but if I had to do it again, I will still go with AC21. Finally it is your risk to take..
I am releived that I got my physical GC in mail today.
 
GC_Aug_05, the Employment Evaluation Letter the company provided to you was directed to USCIS, or was just a generic "To Whom It May Concern" letter and then your lawyer wrote a letter to USCIS outlining the AC21 language ?
Small details, but if I didn't even have to mention the hassle AC21 thing to the company and could get a standard EVL, that would be so much easier.

Saras, I understand your position. I also have my reservations about AC21, but I decided that if a new opportunities comes, I will not miss it again. I just hope your PD becomes current soon... but then again these are insane times.

I received a template format from my attorny for AC21 letter

My attorny provided a template, and I had to work with my HR dept, to get the customized version. HR did add a few things in letter like "company is employment-at-will" cause, that attorney did not like so much.

In the top, it says "TO WHOSOEVER IT MAY CONCERN". Then it is pretty generic, mentioning job title, salary, full time time employee etc.
However at the last paragragh, it does mention "Accordingly, we respectfully request that you grant him approval of the I-485 Application in order for him and his family to obtain their permanent residency status soon.

The attorney did provide whole bunch documentation about AC21 provisions, USCIS memos about AC21 etc. and did a very proffesional job.

I had mentioned to HR, that I will need one EVL letter immediately after I join and they happily provided it to me. The funny thing was I had to get the same letter not once but 3 times, once for invoking AC21, second time for RFE response and third time just before the local office interview.

Thanks for posting the details. I agree with company that the usual language is "employment-at-will". I am glad evertyhing went alright.
