GC Thru marriage, Application and Interim EAD Rejected..please help

This is for a close relative of mine..and following are his woes :

I have been on H1 for past 5 years...(6'th year ending in oct 04)......I have got married here and my wife is a US citizen..we have a baby boy who is 3 years old now...I applied for my adjustment of status (i-130 and I-1485)..and after 3 months...applied for EAD.... because it was more than 90 days since I apploed. I did not recieve a reply and then made an appointment to get an Interim EAD ..I thought i would get my EAD but to my utter disdain..I was informed that my EAD was denied and no reason was given.

My original application for adjustment of status has been denied as well....they just say that they have mailed me the notice on the 19th(August).....which i have not recieved to date..its more than 2 weeks now...i have been trying to get some info but no luck..anyway...what would be my options for staying on ?...can i get a letter from my employer stating that if I do not have an EAD they would have to terminate me ? will that help ?? -- i read this as one of the requirement for employment based GC..not sure if it applies to me though...am utterly confused ...Also...since oct is just a month away...and i have not recieved the notice to enable my lawyer to reply to it...what can i do ?? please help.

ok something is really wrong here

your wife is citizen and you have a kid together

this case should have been a slam dunk.

yeah you can't do anything until you get a denial letter.

once you do then you can appeal the decision using form I-694.

The final option would be to send a letter to your local congressman.

I'm on H1 too and my wife just got the Oath letter and she's going to be a citizen soon. i'm just waiting for the day to apply for AOS, now the time has come. I'm just curious to know the denial. After seeing your case, looks like anything is possible. my question is:
Why in the first place you were waiting for so long to apply for GC when your wife is a Citizen. I would never do that or as a matter of fact nobody would do that.

When I came here..my wife was a GC holder, she got her citizenship status just 6 months ago...thats why we were late :-))..you are right..nobody wud ever do that....but now u know why I did...anyway..jokes apart...yeah...that was a rude shock....My only point is...I hope there is no legislation about how long before you can appeal..i mean..I hope it does'nt come to such a state that my 6'th year is up...and my appeal has'nt even been heard....what should I do in such a situation...I wonder...

By the way bb_555..thanks...and yeah...i feel the same too that something is wrong...basically, I have never been out of status..no criminal record no felonies..nothing...>> anything else that you can suggest would be great..thanks again!

I am H1B holder. My company is ready to process my GC. To avoid I-140( 6 months binding) I applied EAD, AP, I-485 through my US citizen wife. I never heard that USCIS rejected application without any valid reason. Definitely there is a mistake. I know some paper less people also got there GC through marry a US citizen. Could you please tell us when did you apply(all the dates), and what kind of supporting documents you attached with your applications? Did you apply through Lawyer or yourself? From which state you applied? Did they send your papers to MSC/NBC?
