GC thru a third employer

Hi guys,

This question probably came up earlier too. However, I would be glad to get a reply from you.

I work for Company A. They are suppossed to apply for my LC as the first step for GC. It is going to be done through company lawyer. My six year H1 ends in Juy, 2005. So I have to apply by July, 2004.

However, I am not very comfortable with company A though they are a pretty big company (9000+ employees) with good profits for last several years.

In the meantime, I talked to a very small company B with very poor profit margin, if any. Company B is ready to sponsor me and ready to file my LC around May,2004 after posting all necessary ads for RIR. I am not sure when I should be joining that company. I have a couple of questions on that front :

1) Do you think it is worthwhile to go through company B even though they have poor financial results?

2) What are the possible implications during I-140 stage?

3) Does the chances of my GC processing get better if I join company B around September,2004 or anytime during the LC process? Can INS still come up with RFE and if they do, do company B have a point against it?

Answer: Not knowing all the fact it is difficult to answer this question. What they look for is whether the company is in a position to pay you the salary mentioned and provide you the position specified. I would personally recommend company A from the little known facts.

Answer: No implications. You can have 2 simultaneous I-140 process going from two companies. But not advisable as this may cause confusion for BCIS.

Answer: Not sure what you mean. I would suggest since you are fighting time...you can file thru company A and company B and proceed..although i would recommend company A due to its financial position!
