GC Through borther's company.

I am working in company A, my green card processing is taking place in company B.
My company B is run by my brother, right now it does not have big revenue too (around 500,000)

1) I want to know whether they would be any impact on my GC based on revenue?

2) Will there be any impact on my GC based on my relation to the owner of the company B.

My state labor is cleared, my LC is under federal processing.

Answer to this would help me leave company A for good, my company A assured me that they would apply for green card pretty soon but if I can get my Gc thru company B, I have no problem leaving my existing company.

You may face problems due to both the reasons you have mentioned. If company B has not done any GC in the past then there are higher chances of trouble.

If company A is big, stable and your job is stable then you are better off doing your GC with them.

Other then that there is chance that if the INS/DOL come to know your relation they may reject your case saying that you need to file as Family based case rather then Employment based case. It may be treated as fraud.
 
Is there any document which states this somewhere, where I can verify. I don't want to insult your suggestion/information, I got conflicting answers to this question.
I want to make sure if what you guys have said is right and be done with it.

I do not quite agree with "tammy2". If you are a qualified professional and the employer has a valid reason and requirments to hire you then there is no justification to treat your case as a fraud.

In theory it is also possile to do your own GC through your own company having yourself as a owner. But there are practical problems to it.

The main risk I see in your case is the size and scale of your Brother's company and lack of any history of doing GC.

I would not take this risk. Hope this helps.

Thanks for the reply ADP, it is quite helpful. I agree with you. I talked to my lawyer, she said that all I have to do is to disclose my relationship so that DOL & other parties can make sure that all the process were not abused because I was related to the owner of the company.

As you said there is a risk involved but I want to verify that the process I am following is not illegal or fraud.

is it possible to apply GC through our own company,
I heared when you are in h1 you can start a company but can not apply green card for yourself.

please claify if you have any links /doc on this please forward

It is okay

My friend opened a company while on H1, along with his American friend. He not only got the H1 through his company but also has the green card now.

Whether you disclose or not, it does not matter as long as the company is making profits and you are getting paid by the company.
