Hi Guys, I need help in getting back into the US.
My husband and our three kids are US citizens and I have a GC since 97.
We have been living overseas since.
Now we need to move back to the US.
Is there a short cut provision in the law or do I need to re apply for GC.
Is any one else in the same situation.

GC Question

My son is a GC holder , I want to send him to England for his boarding school, can he go abroad for studies for more than a year,or he will get problem to reentry in USA,
Please help

180 days limit

I could be wrong but to my understanding INS sets the 180 days limit for GC holders for being outside the US. If a GC holder stays more than 180 days, he/she will be considered abandoning their permanent residence therefore will be denied entry. Make sure you have advance permission from INS if you are planning to be absent for more than 6mos.

Green Card Reg.

Hi
I recently transferred my H-1 to a company where I am the first employee and possible chance of increasing the employees in future. I asked my employer to sponsor for my GC, he says he need to meet certain criteria before applying for GC. Can anyone tell me what are the conditions for applying for GC from the employer’s perspective? Appreciate your help.

Able to pay the proffered wage us just one problem

The employer will also likely be questioned about whether there really is a job that is available to other candidates. With only one US employee, there will be serious questions about that. If the employee also has an ownership interest, or is related to an owner, the problems may become insurmountable.
