LAYOFFBABA: In reality if all rules were implemented, for those who come from overseas, obtain a US degree and continue to work in US, it would be a bigger violation (compared to H1B holders) as the premise of granting F1 is to return back to their home country once a student obtains a degree.
In most cases, F1s hang around (mostly illegal stay) to get a job (which may not be immediate) once they finish their degrees.
Additionally, most F1s from India come to US straight after college and hence have no work experience. Labor clearance stipulates that the person have the work experience at the time of filing for Labor and not during the GC filing. If that was really implemented, sadly most F1s (at least during their first job or the first few years after degree) will not be eligible to file for GC.
