GC never received. Is filing I-90 going to help?

Hello everyone,

I had my AOS interview at Garden City, NY in April 2005 (married to a USC), then I got my passport stamped in August 2005....but I never received the actual card.
I want to file an I-90 form for card that was never received .
I was just wondering if anyone knows what can I expect if I do it. Would it help, or would it be just like all the other inquiries that I have sent / opened with USCIS over the phone that I never got answers to...
I have nothing to lose if I send it, but I just don't want to put big hopes on it if it doesn't really do much. I had enough dissapoitments in the last 4 years since I started this whole process.
Please share your knowledge on this.

Just having an interview doesn't mean you'll get your GC. The question here is did they approve you case after the interview? Did you receive any approval notice? If the answer is "yes", then you can fill out this form.

At the interview we were told that everything is OK and I am approved for permanent residence, and I should expect the card within 3 months.
I also had my passport stamped and It says:
Processed for I-551. Temporary evidence of lawful admission for permanent residence. Valid untill xx/xx/06.Employment authorized.

I did not receive a welcome notice, but I thought the stamp is a prove that I am approved....I don't think they would've stamped my passport if anything was wrong.
I was able to leave the country and come back last summer with no problems at all...

Let me know if I am wrong thinking I am approved...
 
Alright then.

OK, now that makes a difference. Having a stamp means you are a Permanent Residence. What I would do is make a copy of your passport page that has that stamp on it and fill out this form and send it to USCIS. If you haven't moved since you got approved or even if you did move and notified them of your new adress by calling and filling our AR-11, then you shouldn't have to pay any fee because then its not your fault. The other options can be;
(1) Call 1800 number and see where it goes (Least hopeful option)
(2) Make an infopass appointment and talk to an I/O in person and explain the situation to him.
(3) Ask your Congressman/Congresswoman to intervene on your behalf (This has helped a lot of people).

I have done all the other things that you suggested.

Do you have any idea how long it will take to get a response from them...I know asking about timelines with USCIS is crazy...but what I mean is - is there such a thing that they "have to" reply to me if I send this form?

Before filing the I-90 to get a new card I recommend you file a G-731 first to find out where the current card is. This may prompt USCIS to send it to you if they have not processed it yet. If you filed the G-731 and the repsonse is that they already sent it to you, but you never got it, then you need to file an I-90, and in this case the fee for the I-90 should be waived.

I filed G-731 in the begining of December - there is no answer yet and I called them at least 2 times since then. One of those times I spoke to an Immigration officer and she told me the card was not mailed yet, but refused to give me any other information.

Should I wait longer for a response to the G-731?

you said you got your passport stamped, right?
so how did you get it stamped on August since your interview was in April, did you go back to Garden City in August? or did you go to 26 Fed. Plaza.
cause I got interview over a month ago, and I was told that I will receive the card by mail from 2 weeks-3 months, and still haven't received nothing. Also they didn't stamp my passport then, the officer only wrote few stuff stating that she saw us that day. So I am confused now, I would like to go somewhere and get my passport stamped.
Can you give me any advice?

I didn't get a stamp at the time of the interview either. The immigration officer did tell me that I am approved and will get the card in the mail in 90 days. So when I reached the 90 days in July, i started calling the USCIS number every week. They didn't give me any info. I also went to the NY DO and then to Garden City again - but that didn't help either. So left with no other optons - I sent a letter to a local congressman and 3 weeks later I got a letter telling me to go to the NYC office to get my passport stamped.
I don't know if it was the congressman who helped, or was it just time for that to happen...but that's how I got the stamp.
At the time of the stamping I was told the card will arrive within 3 months...and it didn't...no surprise though...i started the GC process in 2002 and nothing ever was easy and on time and I had enough time to learn that tracking your stuff and calling them all the time is the way to go.

You are following the correct process. I don't think an I-90 will help you. My guess is it probably will take them at least 90 days to reply to the G-731, and chances are that they will tell you they have not sent it yet, if that is what they told you on the phone. If that is a fact, then the I-90 would not help, since the card was neither lost, stolen, nor issued with errors. My guess is that the G-731 is taking so long to process because they are trying to determine the reason WHY your card as not been mailed yet. By digging for this reason, I presume that will trigger the card to get released from whatever process is holding it back.

There is no official G-731 processing time unfortunately as far as I know.
 
Try everything that could work. In the same boat here. We have called 800 number several times; then we tried and filed G-731 twice; took info-pass; and now trying congressman. The immigration officer we spoke to last on 800 number advised to file I-90, which has been done.

The same week that I-90 was filed, two welcome letters were recieved for my spouse but none for me. We used the receipt number to track the status of the card for spouse. The card was ordered two days ago and expect to recieve it soon. Also, using the last two digits of the reciept number, we did a search for other receipt numbers before and after the one for spouse. The same message that card has been ordered two days ago. We are hoping that mine will be one of those receipt numbers.

There may be no correlation, but it appears that the last G-731 may have triggered the welcome letters.

I-90 could also help. A friend got stamped more than 2 years ago, but no card was received. I-90 was filed in Nov, 2005, which was acknowledged. Two weeks ago, a letter was received that 2 passport photographs should be sent. This implies that the file was retreived after I-90, but photographs were missing or judged too old for ordering the card.
