Weird question (but guess common)

Can I demand my green card related expenses (which was paid from my after-tax money) from my ex-employer? My labor was approved just before I resigned and they have substituted another candidate on the same labor. I don't think it is fair as they are taking advantage of my investments.

Do I have any legal right to claim that?

Thanks,

Well Its definitly Weird question ?

You dont have right to ask for that expenses, Once you have resigned the company...

You can sue the company ??? Always

Your Winning Chances ???? "0" in a Million or Billion

Take it easy :)

They are holding some money for some reason clearly not applicable according to employment agreement. I explained things, but they are still not releasing my payments. So it's not very old story.

Guess, I do not have any rights then no point in raising this issue.

Sudhaker,

Unfortunately, here in US, laws written or bills passed are in such a way they are very favorable to businesses... than regular individuals, it kinda makes sense sometimes because they are the ones paying salaries to regular people.... but then, some businesses really misuse this...

it takes a lot more than you and me losing money to change this... I recently read somewhere about Labor Substitution being banned... it sounds like it is going to become a reality soon.... it is under review by DOL as I write this, i heard...

as for now, i am not sure you can do much... google on "Labor Substitution" to find about this ban...keep an eye, if you are so bent on punishing your employer, maybe you can file a complaint with USCIS ?
