I agree with S Prabhu. I was trying to determine how far were you from being eligible for USC.
You may be in for a long wait. The worst case scenario is that she can get turned down and then you file the I-130 as a PR and she will be given the Vvisa after 2 years ( or is it 3 years ).
For your sake, I hope that she is granted the non immigrant visa. Please make sure that she tells them the facts.
The V-Visa law was passed for those beneficiaries whose applications were filed before Dec 21'st 99. The Senate & or the congress dosent have an intention of renewing that Law again any time soon.
So the only option available is to get a H-1B or a F1 visa.
F-1 is unlikely since marriage to a PR would almost certainly be considered indicative of an intent to immigrate, which is obviously incompatible with an F-1. At very least, she would need to proceed with EXTREME caution.
