GC Holder or US Citizen petitioning spouse

Hi Everyone,

Please post your experiences when you had your petition for your spouse.

My wife and I are married for 3 years, but we only have 1 joint account (just recently opened and we don't have kids yet. We only get to be together for only 3 weeks / year, when I save up my whole vacation time

But we have phone bills, pictures together for the past years, and Western Union remittances receipts (for 1 year)...

Is anyone here, experienced getting petition denied due to lack of joint ownership? such as house, banks, etc...???
 
Is your wife here in the US and adjusting status while inside the US or you are doing consular processing?

if you are doing AOS, get ready and expecting to be hammered by the interview officer. You'll need to gather as much as evidence as possible including affividits from other people. Is there a reason why you don't live together?

If for consular processing, all you need is your marriage cert and prove of citizenship.

She's in the Philippines. And she's just waiting for my petition.

The previous post is not enough? Here you go again....

If you are also in the philipines and filing I130 at the embassy. You'll need your US passport, marriage certificate plus other evidence showing a bonafide marriage.

Hi Bestpal,

Your input is very much appreciated and I've learned from it. Please don't get me wrong, I just wanna hear more experiences as much as possible, and maybe there are more people who has the same case as mine.

I am worried that my petition to my wife will be denied due to lack of Joint Ownership.

They don't expect you to have joint anything if your spouse is living in another country due to immigration restrictions. It's when both spouses already live in the US that they will expect evidence of joint accounts and assets.

are you a Filipino...

I myself is waiting for my wife to come in here... hopefully she can come here by august, shes also the the Philippines...

all im waiting now is for the NVC to contact me and send me whatever paper they need me to fill up...

my case is a bit different from most... when I file my I-130, my wife was here.. when the petition was granted, she came back to the philippines... so instead of USCIS automatically forwarding the approved petition, I had to submit form I-824, request for further action, so that USCIS can forward it to NVC... and thats where I am right now... it has been 3 months since I submitted that I-824 but still havent heard nor received anything...

Yes I am a Filipino. My wife is a Filipina as well, she have'nt been here. So I need to submit my petition for direct Consular Processing.

Why did your wife needs to go back to Philippines, can't she just apply for an AOS?

Whenever you receive an update with regards to your wife's petition please let me know.

im here in the east coast... it was a tough decision she had to make... her sister died and she could no bear the burden of not seeing her for the final time... so she had to leave... as mentioned, when i submitted the i-130, the intention was for her to just go for an AOS... so when i got the approval, USCIS told me that since she is no longer here in the states, the petition need to undergo CP in Manila... they told me I needed to submit an I-824, request for further action on an approved petition so they can forward it to NVC...

its a pain for two reasons... one, i has to pay another $340 for the I-824 when all they needed to do was notify NVC that the petition was approved. second, its taking time for USCIS to forward it to NVC... as a matter of fact, it says that it should take ano more than 6 months... its been 3 months now but still, i have not heard/recieved anything from USCIS or NVC...
