Been in the US for 3 plus years as a GC holder I plan to go back home later this year and marry my fiancee. Being that filling for spouse for GC holder takes about 5 years my initial plan was to wait till am citizen to file for her. My brother in law did the same thing and its been dragging for a while now and am keen to avoid this. Someone advised me to fie a petition for my spouse as soon as we are legally married even though I wont be citizen yet apparently doing so means that she may be given her GC as soon as I gain citizenship. Is this true are there advantages to not waiting for citizenship? The obvious disadvantage is shes disqualified for non immigrant visa as soon as i file. Please help

If you were less than 6 months away from citizenship eligibility, it might be better to wait until you have citizenship, but with your citizenship eligibility being 2 years away you should file for her ASAP after you marry.

The wait for spouses of GC holders has dropped to under 3 years. And even if you don't file for her, once you get married she probably won't be able to get a nonimmigrant visa anyway, because on the visa application she must list all close family in the US including spouse or fiance.
