GC Future Employment..Please help

I am currently on a J2 visa(J1 dependent). I want to file for a green card through a company by RIR. I am not on their payroll and want to do GC for future employment. How does that work ? Any problems doing it that way ?

My 6 years expire in Feb'05
I am a permanent employee of Company A in California. They filed my labor certification in Feb'2004 in non-RIR ( to take advantage of 1 year rule).
Now can I apply for labor cerification thru company B ( a consulting firm) in CA also. They have a laborcertification pending and they will transfer in into my name. This is in RIR. Please advise.

Substiture Labor before approval

Attorney says they file for substitute labor even if the labor is not approved. Is that true. Can we trust him. Let me eloborate.
Company X filed for labor for a person and is pending in state - CA.
Is it true that we can change the labor to our name even before it is approved.
