GC Fraud through Marriage

Hi ,
I met a girl last year outside the country and married her and got her into the country on a Green Card. However she abandoned me within 1 month of comming into the country. I tried several ways to locate her ad finally found that she is living with some family in another state and does not want to talk to me. I feel defrauded because it does appear that she had no intent to enter into a valid marraige with me except to gain entry into the country. The following are the facts:

1. Married me in may 2001 but made a pretex of 'some work' outside the country not to come with me on a temprory visa and asked me to send her the Green card papers.

2 Came to the country only on getting the Green card

3. Lived with me for 1 month and then left me on pretex of 'some work' outside the country

4. Rentered country but never contacted me and refused to see me when i traced her down.

5. Openly stated (have witnesses) that I have Green card so I dont need you.

6. Never allowed marraige to be consumated, possibly due to inability/unwillingness to have sexual intercourse.

7. I hired a private investigator and found that her family is involved in major tax fraud in the old country and were looking for a way to move money to US out of the old country. I may have been caught in their fraud scheme.


Can I file for anullment based on fraud ? I realise there is a lot of burden of proof on me but I feel totally defrauded by this indivudual. Appreciate any responses.

You sponser her green card with you as a citizen petioner, right?
If so, I think that you can complain to the INS. In such cases,
I think there is a great chance the INS will deport yoru wife.
 
Fraud

Hi, this was through Consular Process outside the US. I was on H1-B when i got married to her, but both got our GC's approved at the same time in US consulate in India.
 
You must let INS know to avoid adverse impact later. Fraud and Forgery, specific to cross border dealings, are being watched with magnified glass. If uncovered DOJ will identify you as party in this mess. Consult a lawyer.
 
Well, usually green card marriage is referred to as soneone
marrying a citizen in order to be sponsored for a GC by the
citizen not a marriage both of parties get their green card
thru employment as primary and derivative appliacant.


an annulled marriage can be treated like it never occurred.
If this also holds for immigration purpose, then if you have your
marriage annulled, your wife will lose her green card. But
I think it is more complex than that.

you married her, sponsored her gc, brought her here to the country and she left you before you could even do the deed!!!

I do know the case of a person in Los Angeles who got his daughter married to a person from India.

Within a few months of their marriage and the receipt of the green card the boy left the girl saying that he did not need her because he got his green card.

The family of the girl approached INS and went through the process and finally deported the boy back to India.

You have to definitely contact an attorney to handle your case.

It can be done but there is an expense involved.
 
Just curious, the GC that you get right after marrige is a conditional GC, valid for 2 years. After that, both husband/wife have to appear together for an interview to have the condition removed. SO will that not be a problem for the girl??

The person was on H1 when he got married and hence his wife got a GC without the 2 years conditional Permanent Resident stamp.
 
if the guy was on H1, how could the wife come on a GC. If after comming here, she filed for adjustment, then it is at least a year's wait right?? If he had the GC, and then applied for GC in the home country, then it is a wait of several years. So, what was the case???

is it ur assumption that the guy was on H1??

The person was on H1 and got married to a girl in India.

His wife did not come to USA along with him but
they opted for Consular processing and when that was completed his (wife) received a green card without any conditions.


Consular processing was completed in India and
Then she came to USA and lived with him for a month and then made some excuses and went back to India and came back to USA but to her parents in another part of USA.
 
Question for RSGC

RSGC,
do you know the family you talked about, did they go through consular processing? or the 2 -year wait to remove conditional status for GC?

The girl is a citizen of the usa. The Boy was from India and got a conditional PR for two years and after two years ditched the girl and the family approached INS and got his gc cancelled because he admitted in front of witnesses that his intention was not to be with her but enjoy his life with other gori gori (white white ) girls.
 
How soon can you apply for divorce after getting GC ?

Do the man and wife to stick together for sometime after getting GC, even if they do not can stand each other any more ?

How long do they have to stick together ?

Especially people in 485 stange do not want to file for Divorce because it may delay or spoil the GC processing altogether.

I had read on a law-firm website a while back that if the GC is non-conditional (i.e. for all I-485 dependent-cases) then the divorce can happen right after approval.


But divorce is such a sad thing. Especially when the family has kids. I hope this is not the case for anyone on this board.

If you ever cared for this girl, then let her be. I suspect that she wasn't as interested as you had hoped, and from your comments, it looks like that little voice in the back of your head was telling you this. So maybe you'd be better off blaming yourself. Just think of it as a silly mistake. Spilled milk.

If you attack, you are certain to hurt yourself more. Don't.
