GC for a step-child without his dad applying

Hi everyone,

I would like to fill a petition for a Green Card for my step-child who is currently in the US on an F-1 student visa. I got married to his dad before his 18th birthday and we live in Europe. My questions are:

(1) Can I petition for my step-son only, or do I have to petition for his dad and then for him?

(2) Can he attend his interviews without me because I am currently in Europe?

(3) How long does this process take?

Is he single and under 21? That greatly affects if and how he can immigrate and how long it will take.

He just turned 18 in December, and yes he is single.

With him being single and under 21, and already in the US legally, he can get a green card in about 6 months. But you'll have to reside in the US to facilitate the process, otherwise you'll face a similar problem as this: http://forums.immigration.com/showt...-refusal-because-Petitioner-needs-US-domicile

Thank you for the answer. I do have an apartment in the US but I live with my husband abroad. Should I come back to the US for his GC interviews?
