Hello everyone,

First, I wish all of you are doing great and that your immigration problems are going through just fine. :)

As a person who doesn't know much about American law, I had a few questions. This is the story:
My fiance applied for political asylum in 2001. The same year, his status was approved by the INS. This January (January 2006), he received his green card.
1) How long (months/years) will it take for him to get the passport?
2) Does the time of processing depend on the state where the application was filed?
3) If I marry my fiance (I am on a B2 visa) now that he is a GC holder, how long would it take for me to get the GC?
4) What if he were a US citizen?

Thank you for your time and effort. Appreciate it and God bless you. :)

Thnx for your reply JoeF.

However, what do you mean that a GC (green card) does not turn into a US passport? I know a lot of people that have won the political asylum, got a green card, and now are US citizens.

Maybe I misunderstood you....

Of course, US citizens get US passports. But a Permanent Resident is not a US citizen. A Permanent Resident can apply for US citizenship after 5 years, and once the person gets sworn in, then the person becomes a US citizen. This is not automatic.

Do you have to be a GC holder to be considered a permanent resident or it can happen even before?
For instance, people who have won the lottary and come to the US as immigrants, when do they get the permanent resident status? When they get the GC or once their status is approved?

p.s. btw, what I really meant by asking "how long does it take a GC holder to get a US passport, I meant US citizenship." But I know getting the citizenship is not automatic. :p

Time period requirements

BKNY,
When an Asylee's status gets adjusted to a PR or in other words when he/she gets the Green card, it is backdated one year. This is due to the waiting period every Asylee goes through. Meaning after your asylum is approved, you have to wait one year before you can apply for your GC. For that one year GC for every asylee is backdated one year (Please note that Refugee's GC is backdated to the date they were give the refugee status). So for exanple, if your friend got approved on 03/17/06, his GC would state that he is Resident since 03/17/05. So he can apply for the US citizenship after 3 years and 9 months after getting approved or 4 years and 9 months from the "Resident since" date on his GC.
I agree with Joe's response about sponsoring you.
Thanks
