Hi! My green card was approved using substitute labor, but the location
of the original labor certification was different from my current work
location (different states).
When we originally filed the 1-140, we gave my current work address
on the I-140 application, but USCIS did catch it and asked to change
the work address, which my employer eventually did.
Then, I was hoping that my 485 would take more than 6 months to approve,
and I could use the portability clause after 6 months, bascially stating
that I am working for same employer, but my work location changed.
But surprise, my 485 was approved in less than 4 months. Now my guess
is that I have to relocate to a new location. My questions are:
1. How long do I have to work out of the new location to be on
the safe side? Based on previous threads, it seems 6-12 months?
2. What evidence should I gather as a valid proof for USCIS, in case
they ever come calling?
3. Is there a way my official work address is changed, but I can
work remotely?
4. Can I live with a friend at the new location without my name being
on the lease? Would that raise the doubt that my intent was not to
move?
thanks!
