Hi All,

Mine was a concurrent filing (AP/EAD/140/485) on SEP 2003. AP/EAD approved on JAN 2004. Got laid off on APR 2004 (140/485 was pending that time and 180 days over). Immediately find another job (similar job, 15% more salary), since I have about 2 years left on my H1B, I did not use EAD instead start working on H1B. Also I did not send AC21.

Recently 140 and 485 got approved almost the same time - during 1 week span (no RFE). Unfortunately I did not get enough time to send the AC21 before the 485 approval. Went for passport stamping, got the stamp and immigration officer didn’t asked anything. Now I got the plastic card also.

Since I did not inform USCIS about the job change during the 140/485 process/approval, Is it okay to send the AC21 now? Or how do I let the USCIS know that I changed the job?

Thanks in advance for the help

Sam

My understanding is that if you do not receive RFE, you even do not need to have a job, which means you do not need to do anything. Anybody has different thought?

As per AC21, you are not required to notify USCIS of job change. People do that to preempt request of current employment letter by USCIS. So you did not do anything wrong.
