GC approved but company closing down

Hi,

My GC was approved just 2 weeks back, i got the stamping notice and i am planning to go for stamping next week. However my company is planning to close down operations completely (shut down) in a couple of months. I have heard/read that you need to stick to your GC sponsoring company for a while after getting your GC approved.

So what do you think is going to happen in my case. Since i am not the one who is quitting the job i think i must be ok but need expert views on this... could you guys please comment. Also is it ok to go W2 now since my GC is approved.

You should be okay

Hi AK2003!

If the company closes down for some reasons, just get a letter from
them saying that you are getting laid off due to a specific reason like
the company going out of business etc. Couple of my friends
had similar situation like you. The company merged with another company
and they lost their jobs in just 2/3 months after getting their GC.


They got their letters from the company stating specifically why they
were being laid off.

Anyway, check with a good attorney yourself, who can better understand
your situation.
