GC approval while traveling out of US

Hi,

I read somewhere that if your GC gets approved while you are out of US, then your GC gets abandoned.

If someone needs to travel (planning to re-enter on H1) and GC gets approved during that time, what happens next?

Are you still allowed to use H1 to enter US?

My GC got approved when I was out of country on vacation. Once your GC is approved, your H1 status become invalid and you may not be able to enter using H1. This is where Advance Parole (AP) help you to re-enter and continue your GC.

I think even if you enter with physical GC thats also fine.
Only thing is some one has to send you the cards to you.

I am also travelling next week, My wife's gc got approved when she was in India . My lawyer told me its fine, while returning she can show the physical card at the POE.
 
GC approval makes H1 as well as AP invalid. In case you are travelling with one of these documents and your GC gets approved while you are out of the country, then on your return, present these documents to the IO at POE and mention that your GC is approved while you were overseas - if they dont already find out from their systems.

You will then be taken to secondary processing at that POE where they will verify your documents and then stamp your passport with the I-551 (GC stamp).

No problems, no hassles, just one additional step before you enter the US ....

My experience is different. My GC was approved and the card received at my residence when I was out of USA. When I entered USA after 2 weeks of GC approval, I presented my AP and asked the officer if there is any difference in procedure due to approval of GC when I was out of the country, I was told "No; There is no difference" and I was paroled back into USA.
I was indeed expecting a I-551 stamp in my passport but instead they stamped the AP and stamped the passport "Paroled Until Augxx 2008 Purpose AOS".
