My I140 is pending at CSC for abt 7 mths now. Also my wife is studying on an H4 and she is not able to take any assistantship /internship that is being offered to her etc .
She is currently on an H4 .Recently I had got an H4 extension approval for her till 9/30/2006.


She graduates in dec 2004 . i am thinking whether it is wise to transfer her to F1 now . i am thinking what will happen if we do not get an EAD till 1 year from now (worst case scenario). atleast she will have an OPT.
My company will not file concurrent in any case.

Kailashr is right. A student on H-4 can get a non-service fellowship/scholarship and also the department can pay the fees/tuition. She cannot do TA/ any other work that F1 students perform.

But some universities might object to getting payment - for example, the university my husband is studying said they don't have H-4 in the drop-down list box in the pament system(very funny, but true!!)

Can you please inform, in your knowledge, if some one has got assitant ship or OPT as of student while on H4 and PAID?
Becasue the quetsion is H4 visa holder can not just recieve or earn income while still on H4!
Do you think then H4 visa holder as student can also work part time as well and earn during the tenure?
can you please post a link where simialr issue is clarified?
Any comments from expereinces on similar,from other memebrs please.

H-4 cannot work, but the department might pay fees if they want to. But it is up to the university/department/professor - they might pay fees/tuition.

H-4 cannot use OPT. There is something called non-service fellowship which is paid witout doing work. Some univs. allow it.
It all depends on the university. But I am pretty sure that fees/tuition can be paid - you don't take home anything.

Too much info is not helpful sometimes. Go to the university and if they accept your wife as a full time student, then enroll her.

My husband graduated with M.S holding a H-4, then enrolled in Ph.D with H-4.

remember one thing . this is a forum .everyone has the right to ask what they want .i just want to get opinions from as many people as i can ....
second thing .the way you have responded in the initial part of ur response seems that you havent had to face the furstrations of immigration. in future try to use a more calm response . or else read the question mumble some words to urself and carry on with your work .

By the way ur second part of the response was useful.
