GC and 7th year extension

I have had my GC filed, present under federal labour for my present company and 7th year H1B extension also been filed. There is one more company which also filled GC and H1B a year back . Can i file 7th year extension with the second company for the approved H1B even through i am not under their payroll.
Any information will be helpful and thanks for your time.

If your are not on their payroll, "YOU CANNOT FILE, LEGALLY". Get the recent paystubs... legally first then apply.
 
Since i am working in the first company i cannot get the
paystub for second company. I am still confused if
i can or cannot apply for 7th year extension with second
company. If i cannot can i transfer the 7th year extension
to the second company ?
 
you can apply 7th year for any no of companies but you have to give information saying that your LC has been files 365 days before your 6 years quota.

you need to get some BCIS letter saying that your case has been filed this date .you have to include this letter for extension

hopefully your attorney or lawyer will take care of this
eventhough your working in company A still you can file 7th year extension from company B
 
But I thought..

if you are not working for a company - the company should withdraw the H1 application.

if you can apply 7th year extension from two companies
since you want to join the second company after some more time when does one have to decide which to apply for 140/485.
I mean you can only 140/485 from only one company right ?

Multiple I140, single I485.
 
Some Question Regarding H1B Extension

Scenario: LC or I140 is pending more than 365 days

1- One gets H1B 7th year extension based on LC,
lets say UPTO April 10 2005. LC gets clear in April 30 2004.
GC (I140 & I485) applied/filed on, say May 15 2004.

Q1: Does this guy still require H1B extension after GC application filed but before April 10 2005 expiry?

Q2: If yes, then from May 15 2004 to April 30 2005 (less than 365 days), what is base of extension?

No - strictly speaking.

Person has a choice - can use extension - may not use it. I would say even if going on EAD - use H1b status till EAD arrives - else will be without money in sugarcane farm till gets EAD.

Basis is LC filing > 365 days.

Once extension is granted - it is not revoked automatically.
