GC about to be revoked

I just got a letter from USCIS wich says they want to revoke my GC after I tried to correct a spelling error in my name on the GC that I have just received in November.
The reason is that I have failed to show up in court in 1994 after I was placed under deportation proceedings for failure to maintain or comply with an nonimmigrant visa. My case in the immigration court was then administratively closed. Then in August of 2003 I was granted Permanent Residency Status after I married My wife who is an American Citizen.
They are now saying because I was under deportation proceedings the jurisdiction lies with the Immigration Court and not with The CIS, and this being the case, the BCIS does not have the authority to consider the application for adjustment of status.
So far this has been a nightmare. I am going to get a lawyer but I wanted to get some insite from experts.
Thanks.

Could you be a little more clearer. How could you have gotten your permanent residency in the firt place despite deportation proceedings against you? That is very intriguing. Was that an INS oversight? Maybe in a pre 9/11 climate you could afford to skip a deportation hearing court date and not be found out. Those things are very difficult these days to get away with. But I am really really intrigued that you actually got your green card despite having being on call for deportation. We could be more helpful if you provie more details.

hi
Its best you find a good attorney. Is this a conditional GC? Can you check the online status and see what it says?

thanks

Thats not possible. There would be a status update on the Alien Registration number once the Case goes to Deportation or anything in that matter.. it's true more information would be helpful.

Sachin do you think that Bruno has not posted his complete story? and it is not possible to get a GC with a deportation notice that was overlooked
thanks

If you have a deportation notice hanging over your head there is no way you could adjust status before the Immigration Judge terminates the removal proceedings.

Bruno in this case would have been ordered removed from the USA if he failed to show up for his removal hearing.

but then again check this out:

you never know what INS does.. ( I do know they lack logic) hahahah

Hi everybody, in 1993 I violated my student visa so the INS sent me a letter to show up in court which I never went to. Back then then if you do not show in court your case is administravely closed, which was what happened to me. When I went for the adjustment of status interview, the immigration officer gave me the GC even after she asked me about my deportation case. So now they are saying that they made a mistake and that they did not have the jurisdiction to give the GC.

Did the officier know and ask you about your deportation case? or was it on your application mentioned by you? Also has your online status changed

Bruno's posting is somewhat unclear since it says that the case was administratively closed. Need to speak with a qualified immigration attorney (note that not all immigration attorneys can handle removal matters and this could become complicated quickly). Need to file a FOIA immediately. It doesn't sound as if this is impossible to overcome but it could get tricky and very expensive.

I thought that too: "adminstratively closed" meant the removal proceedings have been made. It's very very odd that despite the removal proceeding record on file Bruno was granted the GC after interview. He may have got lucky. But Attorneys like Jim Mills will of course know better.
Bruno when did you adjust status?
