Gauging the Impact of 245(i) on processing times.

It appears that people filing for AOS past March 2001 are caught in the huge delays due to the 245 applications. Not only are adjudications taking a lot longer, folks are not even getting receipts!!

Does anyone know what happens to 245(i) petitions once they are entered in the system?

- Are they handled within the same queue as EB AOS?
- How long is the official adjudication time for each 245 petition?
- How many 245 did CSC receive?

Let\'s proactively find out what to expect out of this 245 mess...

Here is some interesting info:

DOL estimates that SESAs throughout the country have received roughly 230,000 permanent labor certification cases during the recent rush of 245(i) filing that ended on April 30, 2001. My Lord!! Uninformed sources also indicate that New York alone received over 47,000 applications during the time. New Jersey also reportedly received 19,000 applications. Massachusetts also reportedly received approximately 10,000(?). About one half of 230,000 cases were filed, according to the DOL sources, in New York and California

If we do math it means CSC received (230,000/2) - 47,000 = 68,000 applications!!

I think 245(i) will have any impact in the near feature with employment immigrations as with 245(i) people file through family based immigrations where they file I 130 first which takes around 2 1/2 years and I 485 after that. Delay for receipt is because of mail room problem due to contractors and heavy applications during that time. I think there won\'t be any in the feature.

family-based AOS applications are filed at the local INS center and not the CSC, VSC etc.
This means that most 245i\'s that are family-based would not be filed at CSC. hence the delays are not related to 245. Am I right in assuming this??

Those cases were submitted to SESAs, NOT CSC.
The family-based 245i cases were submitted to local INS, NOT CSC.
I agree that 245i will impact CSC later.
But I don\'t understand how the 245(i) dramatically impact CSC now.

As I understand, the Santa Ana local office has merged with CSC and has opened a new office. I am assuming that this is a combined workforce.. this will mean that CSC will be affected by the 245 applications..

This is getting really frustrating.. 4 months back ppl used to get 485 approval within 3 months of filing.. Its been 4 months now and there is no sign of FPs ...

I don\'t think we are going to receive any FPs till the date on the JIT moves. What I gather is that the FPs are sent by the computer and since the validity of FP is only 15 months, unless the JIT date becomes mid 2000, we are not going to see any FPs...

at least with the AC 21, we have kind of freedom after 180 days...
