Gap in employment

I am a Feb'02 filer. ND: 15th February.

I switched job in Nov 02 on AC21 but was laid off on April15th this year. Luckily I do not receive RFE in this time period and now I am getting a decent offer to start from next Monday.

How will this 2 months gap in employment affect me?

First of all congratulations on your new employment.

As soon as you filed your AOS whether you work or not you are in status. So gap in employment will not affect you at all. All that you need is a new employment offer according to AC21 rules.

thats the thing that really secures the
485 situation...

I completely agree with you Sri4GC,
but thats really thin ice you are talking
about- at one hand, ins recognises that
the GC is for future employment, but on the
other- go prove it- its words in the air...
Best thing to use as a proof, is to work
now...
