gap between H1B1 expiration and Interim EAD

Hi,

The six year term for my H1B1 is coming to an end in the mid of this month. I have filed for I485 and have also received receipt for AOS and EAD. I went to INS for getting Interim EAD 03/03/2003. I have been given an appointment letter that is asking me to come on 03/26/2003 and collect iEAD. This is 10days after expiration of my H1B1 and I94. I am already on the job and can I work for these 10days of gap when I do not have H1B1 and iEAD will be given after 10days. Please advise.

I think an attorney only should be able to suggest you in this case. As this not your fault and you should have got the iEAD same day as in many INS offices. I will be in your situation very soon so I would really appreciate, if you could please help me with my queries whenever you have time.

- Could you please tell me which INS office you went to?
- What are the documents you took with you when you went to
the INS first time and what actually you had to submit?
- What documents/ Fee/ Photos they have advised to bring along
when you go on 03/26/2003?
- I understand that iEAD is only valid for 8 months or 240 days,
do you know if you would get an original EAD your filed the
application for also when it's approved.

Please let me know, what you find out about the 10 days thing.

I went to Arlington, VA INS office. My case is getting processed by TSC

- What are the documents you took with you when you went to
the INS first time and what actually you had to submit?

I485 receipt copy, I765 Original & copy, DL, Passport, letter of employment from company, Address Change copy (as I changed my address and wanted to confirm the change at INS), copy of H1B1 approval.

I submitted copy of I485 and I765. For verification they asked DL and passport.

- What documents/ Fee/ Photos they have advised to bring along
when you go on 03/26/2003?

They asked me to get DL, passport and appointment letter issued by INS.

- I understand that iEAD is only valid for 8 months or 240 days,
do you know if you would get an original EAD your filed the
application for also when it's approved.

Validity of iEAD could be 3 months to 1 year. I am not sure of issuance of original EAD.
