Hi,

I filed my AOS earlier and I had a case of priority date re-capture. My Attorney did not file it properly and couldn't re-capture the priority date. I recently transferred my case to another attorney and he needed a G-28 from the employer to talk to USCIS to re-capture priority date based on the approved I-140 my employer has. My employer provided G-28. Now, I am about to leave my employer based on AC21 as I have a great offer from another Company. Is it possible for my employer to revoke the G-28 he provided to the new attorney? Any help regarding this matter will be highly appreciated.

You can bypass the employer once your I-485 is pending for more than 180 days (better if I-140 is approved). The employer cannot revoke the G-28 for I-485 case ... with a G-28 the service center will contact the attorney. otherwise they should contact you directly.
