Suppose somebody is working for a company that is processing his green card, and in the 485 stage after waiting for a really long time, the guy decides to join another company using his EAD with a slightly different title, role and salary. When he gets an RFE, can he send a future employment letter from his original company saying though he is currently not employed by them(he was, for a long time in the beginning), they are still willing to hire him once the green card is approved in accordance with what is stated on the 140?

Would this work? The guy clearly cannot invoke AC21, but he still has the original offer open...will INS get convinced by this explanation?
 
Yes, it may work though USCIS would be a little suspicious of the person working for the employer, leaving them, and then joining back after GC approval. Will need to have a good reason to do so (policy change at employer - only hire after GC).

Why do you believe he cannot avail AC-21 benefits and just change to the new employer?
