My I-485 has been pending for a long time pretty much nothing is going to happen till 2008 or longer.
I am thinking about going to school for full time studies for MBA.

1)How can I apply for EAD or parole renewal as I will not have paychecks?

2)If their is an RFE I have a friend's company willing to give me empolyment letter for future offer. At any point will I be out of status, MBA will take approx. 17 months?

3)Can I consider myself as a permanent resident since my I485 is pending?

Since the whole AC-21 is such a grey area you should take a lot of precautions, if you are on h1 status, I would suggest to move into f1 status and pursue studies, if at some point your visa is current get the gc from your old case and AC-21. If for some reason it is denied you can atleast port your PD with a new company and be back to square one.

Here is the scenario:

If you go to full time school, you will leave your present job.
If your current employer do not withdrawal his consent to hire you upon approval of I 485, you should be fine but on approval, you need employment offer supported with AC21.

If your employer sent his consent to USCIS that his firm is no longer interested to hire you upon approval of I 485, USCIS will issue letter of intent to deny and you have to show USCIS a new offer supported with AC 21.

What about EAD/parole can I apply for them without pay checks?
To clarify further I am not in H1B status, my spouse is however maitaining her H1B is it a good idea for me to get H4 status and pursue full time MBA?

I know there are risks involved in doing full time MBA but I have to take a chance , I have already waited for 3 years. At the end of day it is better to have worthwhile education than green card.

How did this happen??

EB3 PD 03/02
I-140 Approved 02/02/05
I-485 Denied >>> Reopened 08/01/05
I-485 Status Enquiry 08/02/06 (No Response)

I-485 denied without PD? Are you from India?

I am also in the same boat as you.
Why not send some private messages and we can discuss over phone

Did u ever get an RFE or was it straight approvals for EAD/parole without paychecks?

I just picked this from Murthy chat
"

Chat User : My employer has filed for my GC. However, I want to go overseas for a year. Can my GC processing continue while I'm overseas for such a long time?

Attorney Murthy : The general rule is that a person's GC can continue while s/he is abroad for a year or two or even longer, since the GC is based on a future job offer. Of course, the employer will have to agree to this arrangement."

So its as good as goign to school full time
in your case probably the last denial occured becos the original employer either revoked I-140 or informed USCIS that they NO LONGER intend to hire your after GC...

I am studying outside of US currently and my employer has agreed to continue my GC processing while I am here..if the PD reaches my date, I will have to do it by CP, not AOS, since I am not present in the US.

Also, to others who are considering studying, there are real good MBA schools outside of US too..and in Canada (where i am now), spouses get open work permits, no more of the H1 crap..other than this, if you are not graduating from a top 15 US schoool, its tough to get jobs you want on H1 later (assuming ur GC dosen't come through)...

I guess you must have explored all options and then come to the conclusion that u willl need to do CP... is that correct?
Let me ask u this, to maintain the GC process u must be applying for AP in time right/.///// and renewing them
