From TN to H1B

Hello,

I am Canadian working under TN status in USA for three years. The company was filing the I-129 for extension each year.

My company has switched me from TN to H1B starting October 2008.

We received I-797C "approval notice" for class H1B.

Conversly to all previous I-797 notices for **past TN** renewals, This H1B approval notice didn't have I-94 attached to it (?)

Any feedback on the reason and would I need to get I-94 for this new visa type (H1B) and how?

Hi Adelkam,

Have you gotten any other information then the previous response? Because I have been told that Canadians DO NOT get an H1B at the consulate. We have to go to a port of Entry to get it activated (the same way you would get a TN if it was not by mail).

So now I am wondering if my company's lawyer is wrong or what.
 
have gone thro same cycle, You need not to go US consulate in Canada. Go to any POE and they will stamp your canadian passport with H1 and issue a new I-94. This is confirmed.
