From TN to H1

I am close to getting an offer of employment in the US. Could one of you experts help/guide me about the next steps?

1. I have my credentials evalution certificate. I have a degree in Electical Engg from India and have been working as a software analyst in Canada for the last 8 years. What documents do I need to show at the border?

2. What should be the format and contents of the letter from the employer? Does the letter need to specify my job details in order to make it fall under the category of Computer Systems? Where can I get a sample letter?

3. Once I am on TN, can my employer put in an application for H1? Will my chaces of renewing the TN get jeopardized because of this?

Thanks.

Ok I got the reply to the third question after reading other posts in this forum. But can someone please help with #1 and 2 above?

From many of the threads I have read, it seems there are a good number of people who continue to get their TN renewed year after year. How does this work? I mean doesn't the service center or the border officials object on the grounds that the person is continuing to work for the same employer while everytime the employer says that the job is not going to last more than an year?

Hi,

You need to make sure you bring all your experience letters since your Engineering degree does not make you fully eligible for CSA. Also, in your sample letter, try to highlight your computer courses which you took in your University. The education needs to be related to the job.

For sample letter, you can PM me. I might be able to guide you.

All the best

Will my resume be sufficient? I cannot get an experience letter from my current employer for obvious reasons. I mean, I can get that only after I have tendered my resignation, which I propose to do only after my TN is approved. Resigning before that could be suicidal, right? I do have a credentials evaluation certificate.

I did not have any computer courses in college. But I have worked as an Analyst for the last 9 years.

How do I PM you? I did not find any contact information in your profile.

Should I get an immigration lawyer? Will that help?

Thanks.

Well, resume is ok but I believe it is not sufficient for showing your work experience. I can put just anything into my resume and claim.

Another way: is to highlight the computer courses which you took in College and show how it ties up to your new job. The degree in something which is not related to CSA has a good chance of being rejected unless 1) You can demonstrate that you took a atleast a few computer related courses in college OR 2) (a rather weak one) work experience letter from past employers.

The TN letter should be very intelligently crafted.
