From F-1 (Student Visa) to Green Card through relative.

I am a full-time student on F-1 visa. My plan is to graduate next year and apply for a PhD. Now, I have an opportunity to apply for permanent residency through my dad. I know that this process takes at least 1 year. If I start the process now, will this intervene with my acceptance to a PhD program next year since starting school requires a new I-20 and a new F-1 status? Such that I will not be able to legally study until the residency is received? My concern is that the school will not be able to provide me with a non-immigrant visa until my immigrant visa is received. Or does it matter at all?

Another important issue, my husband is a PhD student right now but he's got a full-time job offer from a US university. This position offers him an H1B (Work) visa. If he applies for residency along with me right now, will he not be able to start work on H1B visa in August since he will be in the process of receiving permanent residency as well?

Your help in understanding this issue is greatly appreciated.

Your category is Third: (F3) Married Sons and Daughters of U.S. Citizens: which means that it will take more than 10 years before your visa number is available.

I think that better option for you two is if your husband could apply for GC through work.

You're married, so make that at least 10 years.

Obtaining a new F1 could be a problem with a pending immigrant petition, but applying for permanent residence won't prevent you or your husband from getting H1B or H4, since H1B/H4 allow immigrant intent.
