From Ead To H1b

I have a question. My H1B expired in Nov 2002. My Wife's H4 expired in June 2002. My lawyer advised not to renew H4 for her as she filed for her EAD and AP. He advised not to apply for H1 either as i had my EAD and AP then. Now i want to know whether can i apply for a H1 now or is it too late.

I dont know the answer to your question, but Why do you want to move to H-1 again. Isn't being on EAD a better option?
 
Being on EAD is much better. And make sure you apply for EAD renewal at least 90 days in advance, just to be doubly sure.
 
I am checking to see what happens if my EAD renewal gets delayed. In that case i cannot work during that time right! Just evaluating my options.
