I know this question has been raised by lots of others, but I am about to make my decision in the next couple of days. I am planning to move to a new company.

1. I have my 485 pending for over 15 months
2. currently on EAD (2nd one, valid till July 2004)
3. Salary (new) is 4% less than LC (old)
4. Job description is 100% match (inlcuding the OC code)
5. Designation is 100% match
6. Geo location is same - Bay area

The new company is much more stabler, and they have agreed to give me EVL etc.

My only concern is the salary, which my lawyer says ok.

I am about to talk to my manager today about my intentions. Please advise as this is one of those things in life that is irreversible.

4% is defendable! If your lawyer has given you the go ahead, then it should be okay, since he knows your case the best. I would suggest that you request your new company to give you an EVL which lumps both your compensation + bonus, which will cover the 4% reduction. That should take care of any problems you have with RFE.

140 is right ,you should be ok! dont get tense enjoy your work. At best as 140 suggets on your EVL ask your emplyer to adjust the 4%( bonus, allowance etc) to somehow show an exact match. Even without it you shoukd be ok.

Don't forget that you've applied for GC for the future job. The standard answer to your problem here was always to ask your company to write a letter showing intent to pay LC salary upon employment on GC.
