Today me and my wife went for early 3rd FP @ New York and the manager over there took our notice and asked when we did our last FP which are less than 6 months old.
He went to a room and came back and told us that we don't have to do 3rd FP, also he wrote on our notice that the 2nd FP is cleared with FBI and every FP is valid for 15 months.
For some time I was confused but he said don't worry I wrote on your notice that this is duplicate.
He said if I know some one I should tell about this.

BTW- The manager was from India.

What does your lawyer say?

I have no comments but please do ask your lawyer.
And ask them to ask AILA for clarification on this.

Also Dec 26 (Your scheduled 3FP date) was just declraded by Bush as a Federal Holiday, so INS centers and offices will be closed on that day.

For me the Schedule date is 12/26/2003
For my wife Schedule date is 12/30/2003

I will ask my Lawyer and am not sure I will get any help from her.

thanks, please answer:

1. Usually the staff just take the notice and arrange FP. You told them you had done 2nd FP recently? or they asked first when you did you 2nd FP?


2. I don't quite understand "For some time I was confused but he said don't worry I wrote on your notice that this is duplicate". The manager wrote somthing on your notice (and what did he write?), but what is "duplicate"? Will he inform BCIS you don't need to do 3rd FP?

Please clarify. I need to go for 3rd FP too next week. Thanks a lot.

My answer was I did on June 19th 2003 and my wife did on July 17th 2003. Also he said that so far 10 peolple he saw with 3rd FP and he told them that they don't need to do it at this time.


Answer to Q2:

The reason I say confused because I didn't want to miss my appointment and I told him that I don't want to miss up with case.
But he said don't worry.

I will contact my Lawyer and see what she say?

Whould your failure in 3rd FP affect your 485 processing? Did you ask him about this?

When I went to 2FP, the staff asked both my wife and me the same questions: "Is this your first FP? When did you do the last FP?" I think this may have become the standard questions for local BICS FP staff since there are more and more 2FPs or even 3FPs. I went for the ealier 2FP, the staff complained to me that almost all 2FPs came ealier than scheduled.

I think this is very good news for all the people who received 3rd FP notices.

I hope USCIS would release a clarification on 3rd FP instead of turning people back as they showup at the Local offices to give the 3rd FPs.

Did you move while you were waiting for I485? If so, which add. did you got the 3FP notice, old one or new one?

I just got my 3FP notice at my new home add. which I filed ar-11 form 6 months ago. I got 2FP notice at my old add. 5 months ago and did it earlier.
