Friend approved without FP just before marriage, What r his options to bring his wife

Its one of those miracles of CSC. My friend got approved in 4 months without FP, concurrent I-140/I-485. He learned about the approval just before leaving for India for marriage :( .

Now he is wondering what are his options to bring his wife ? Please help this unlucky lucky guy.
 
Since his marriage occured after he was approved an I-130 Petition for Alien Relative will have to be filed. NSC (Nebraska Service Center) is currently adjudicating application for spouse of permanent resident received on or before April 13, 2001. Looks like the expected wait time is 3.5 years as of now.

An H1 is a dual intent visa so that makes sense. If one applies for an H1 while out of the US and is married to a GC holder, would it be more likely to get rejected? Normally I wouldn’t think so.

Can your friend deny such approval and ask for USCIS to take the
GC back and to approve it only after FP? His has legitmate reason
to demand such.

It is not only possible, but it is also his responsibility to request FP be comepleted. It is called civic responsibility.

reason I ask this is that it is pretty well documented that there are numerous checks performed on an application that has to do with inadmissability, ie., name check, ibis, fingerprints, etc.

I imagine that there is an overlap between when fbi does a name check and fingerprint check. I imagine that a fingerprint check determines if you have been arrested or have a criminal record. Name check performed by FBI would check warrants, terrorism, etc., things that they would not have a fingerprint for.

From a common sense point of view I would think that when a name check is performed it would flag if one also had a criminal record.

I know that name check has many pitfalls that fingerprints don't, but there may be a possibility that a name check could be all inclusive and could also check if the person has an arrest or criminal record. Maybe this is why some people have gotten approved without a fingerprint.

Any thoughts.

Everything you write there would be accurate if only you added a statement at the top saying, "Everything listed here is my imagination and not reality".

FP and name check are not the same. They are performed by different groups inside FBI. They are meant to track different things. Name check is not all-inclusive. I could provide more details, but I will stop here and respond after some moron refutes my claims.
