Fresh H1B from L1

Hi,

I am currently on L1A ,my 7 yrs cap period is expiring in June 2010. I have taken total 3 months vacation till now.
I would be completing 6 calendar years in US by Aug 2009.

1)Do I need to be out of US for 1 year before I apply fresh H1B or L1 ?

2)Can I apply for H1B with new employer in April 2009 quota? and go out of country for 1 year meanwhile get visa stamping done come back to US?

3)During this one year period can i come to US on business visa?

1. Yes.
2. You can start the process while abroad (applying for visa find a project and do visa stamping etc).
3. Yes you can as long as it is a short visit (few weeks at the most).
